1. Who We Are

Nudge ("the Service") is operated by TLK Intelligence Pty Ltd, a company registered in Australia. Our registered address is Sydney, New South Wales, Australia. You can contact us at hello@wenudge.net.

2. What Nudge Is

Nudge is a digital identity platform that lets you create a page at wenudge.net/yourhandle containing your links, social profiles, embedded media, and an AI assistant powered by Anthropic's Claude. It is not a general-purpose AI assistant, chat platform, customer support system, or help desk.

3. Your Account

You must be 18 or older to create an account. You are responsible for keeping your login credentials secure. You may not share your account or use it for multiple people or businesses without a Business plan.

You own your content. By posting it on Nudge you give us a licence to display and deliver it to visitors of your page.

4. Acceptable Use

You must not use Nudge to:

• Post illegal, abusive, threatening, defamatory, or fraudulent content
• Impersonate another person or organisation
• Distribute malware, spam, or phishing links
• Scrape, crawl, or automate requests to the platform
• Attempt to gain unauthorised access to other accounts or systems
• Use the AI feature as a substitute for professional advice (legal, medical, financial)
• Resell or white-label the Service without written permission

We reserve the right to suspend or terminate accounts that violate these terms without notice.

5. Alex AI — Fair Use Policy

The Alex AI feature is designed to help visitors learn about you and take action. It is not a general chatbot. Fair use limits apply:

• Free plan: Alex is available during onboarding only. No visitor chat.
• Pro plan: 300 visitor messages per month across your page
• Business plan: 1,000 visitor messages per month
• All plans: 8 messages maximum per visitor session
• Message input is limited to 280 characters per message

Automated, scripted, or bulk use of the AI feature will result in immediate suspension. Limits reset on the same calendar date each month.

6. Payments and Subscriptions

Paid plans (Pro and Business) are billed monthly. Payments are processed by Stripe. Your credit card statement will show NUDGE BY TLK. Prices are shown in AUD and may be displayed in your local currency at checkout using Stripe's adaptive pricing. Applicable taxes (GST, VAT etc.) are added at checkout where required by law.

You may cancel at any time. Cancellation takes effect at the end of your current billing period. We do not offer refunds for partial months.

7. Intellectual Property

Nudge, the Nudge brand, Alex AI, and all platform code and design are owned by TLK Intelligence Pty Ltd. Your content remains yours. You may not copy, reverse engineer, or create derivative works of the platform.

8. Limitation of Liability

The Service is provided "as is" without warranty. To the maximum extent permitted by Australian law, TLK Intelligence Pty Ltd is not liable for any indirect, incidental, or consequential damages arising from your use of the Service.

9. Privacy

Our Privacy Policy explains how we collect and use your data. By using Nudge you agree to our Privacy Policy.

10. Changes to These Terms

We may update these terms at any time. We will notify you by email or via the dashboard for material changes. Continued use after changes constitutes acceptance.

11. Governing Law

These terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
